These Terms of Use (the “Terms”) govern your access to and use of the website, platforms, portals, and applications (collectively, the “Platforms”) provided by Wandercraft S.A.S. and its subsidiaries, affiliates, and all entities managed or controlled by Wandercraft S.A.S. (“Wandercraft,” “we,” “us,” or “our”).
In the event of a conflict between the General Terms and Conditions (A.) and the platform-specific terms and conditions in other sections, the specific terms and conditions shall take precedence.
By using, downloading, accessing, or creating an account on the platforms, you agree to these terms. If you do not agree to these terms, please do not use the platforms.
In the event of any conflict, ambiguity, or discrepancy between the French version and a translated version, the French version shall prevail, unless mandatory local law requires that the version in the respective national language take precedence for the purpose of consumer protection.
These Terms constitute a legally binding agreement between you and Wandercraft. The Platforms are provided solely for lawful purposes that are consistent with these Terms. Your use of the Platforms is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
Where applicable, Wandercraft may deny, restrict, suspend, or revoke access if the access requirements are not met, if access credentials were issued in error, or if continued access would raise legal, regulatory, security, or safety concerns.
To access certain platforms (e.g., Eve by Wandercraft), you must create or activate an account using login credentials approved by Wandercraft, such as your email address.
You agree to provide accurate, current, and complete information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@wandercraft.health if you suspect any unauthorized access, compromise of your login credentials, or misuse.
You may not share your account with another person, use another user's login credentials, or attempt to circumvent access controls or authentication measures. Wandercraft may require identity verification, account revalidation, or additional security measures at any time.
You agree to refrain from doing the following:
You are solely responsible for the content you enter. You are responsible for verifying that your information is accurate and, if applicable, for deciding which optional notes or information you wish to provide. You should not enter any information that you would be uncomfortable having stored electronically.
Your use of the platforms involves the collection and processing of personal data, as described in our Privacy Policy.
If you would like to request a change to a permit you previously obtained, please contact privacy@wandercraft.health. Revoking access does not affect the lawfulness of any access or disclosure that occurred prior to your revocation.
The platforms, including their software, design, structure, interfaces, text, drawings, graphics, audiovisual elements, sounds, trademarks, service marks, logos, know-how, and other content owned by Wandercraft or its licensors, are protected by intellectual property law and other laws. The same applies to the databases created by Wandercraft (“producer”).
Unless expressly permitted by law or these Terms, you may not copy, reproduce, distribute, display, publicly perform, publish, create derivative works from, reverse engineer, or exploit the Platforms or any part thereof. You may not use Wandercraft’s intellectual property without prior written permission.
If you submit feedback, suggestions, or ideas regarding the platforms, you grant Wandercraft a worldwide, perpetual, irrevocable, and royalty-free right to use such feedback without restriction and without compensation.
You may stop using the platform at any time. Wandercraft may suspend, restrict, or terminate your access, with or without notice, to the extent permitted by law, if: you violate these Terms; your access authorization changes; your account poses a security, privacy, or fraud risk; we are required to do so by law or by a regulatory authority; maintenance or security considerations require it; or we discontinue the platform.
Upon termination, any license granted to you under these Terms shall immediately terminate. Provisions that, by their nature, are intended to survive termination—including, in particular, the provisions regarding intellectual property, disclaimers of warranty, limitations of liability, governing law, and dispute resolution—shall remain in effect.
Wandercraft makes every effort to provide you with available and verified information and/or tools. Despite our best efforts, the information is provided “as is.” With the exception of regulatory documentation, the information on the platforms is non-binding, may contain technical or typographical inaccuracies, and is subject to change without notice. You may report omissions or errors to us by email at contact@wandercraft.health.
To the extent permitted by law, the platforms are provided “as is” and “as available.” Wandercraft disclaims all express, implied, statutory, or other warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement of third-party rights, as well as any warranties arising from course of dealing or trade usage.
Without limiting the foregoing, Wandercraft does not warrant that the platforms will be uninterrupted, secure, error-free, available in a timely manner, clinically suitable, compatible with all devices, or free from loss, damage, or delay.
In some jurisdictions, the exclusion of certain warranties is not permitted, so some of the above exclusions may not apply to you. These terms do not limit any mandatory statutory rights to which you are entitled as a consumer.
To the extent permitted by law, Wandercraft and its affiliates, licensors, service providers, and its personnel shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, nor for lost profits, lost revenue, loss of business value, loss of use, or loss of data arising out of or in connection with the platforms, even if advised of the possibility of such damages.
Wandercraft’s total liability for all claims arising out of or in connection with the Platforms or these Terms shall not exceed one hundred euros (100 EUR) or the amount you expressly paid for the Platform during the twelve months prior to the event giving rise to the claim, whichever is greater.
These terms and conditions neither exclude nor limit any liability that cannot be excluded or limited under applicable law; this applies in particular to liability for fraud, willful misconduct, gross negligence, injury to life, limb, or health, product liability, violations of applicable data protection laws, and violations of mandatory consumer rights.
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Wandercraft and its affiliates from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with (a) your breach of these Terms, (b) your unlawful, fraudulent, or negligent use of the Platforms, or (c) your violation of applicable law or the rights of third parties, or that are related thereto. This indemnification does not apply to the extent that the claim is based on Wandercraft’s own negligence, willful misconduct, or a breach by Wandercraft of these Terms.
We may provide links to websites that are not operated by Wandercraft. If you visit any of these linked websites, we recommend that you review their policies, including their privacy policies. We are not responsible for the policies and practices of other companies.
Wandercraft agrees to remove links to other websites upon the first request from the companies that own the linked websites. Wandercraft must provide its prior written consent before a hyperlink to its website is posted, and reserves the right to remove such a link at any time.
Wandercraft may, from time to time, modify, update, suspend, or discontinue the platforms, in whole or in part, for operational, security-related, legal, regulatory, product-related, or safety reasons. We may also update these Terms. If we make material changes, we will provide notice in an appropriate manner, such as through a pop-up notice on the platform and/or via email. Your continued use of the relevant platforms after the amended terms take effect constitutes your acceptance of the updated terms.
These Terms are governed by French law, without regard to conflict-of-laws principles, unless mandatory consumer protection laws of your country of residence apply and cannot be excluded. If an amicable settlement in good faith cannot be reached between you and Wandercraft, any dispute, claim, or controversy arising out of or relating to these Terms shall be submitted to the competent courts in Paris, France, unless mandatory law grants you the right to bring the matter before another competent court.
For U.S. users only: These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles; however, the arbitration agreement below is governed by the Federal Arbitration Act. Any dispute arising out of or relating to these Terms or your use of the Platforms shall be resolved through binding individual arbitration conducted by the American Arbitration Association in accordance with its Consumer Arbitration Rules; however, either party may bring an individual claim in small claims court. The arbitral tribunal shall decide all preliminary issues regarding arbitrability, except for objections to the class action waiver set forth below, which shall be decided by a court. You and Wandercraft Inc. waive any right to a jury trial and any right to initiate or participate in any class, group, or representative action. Claims must be brought individually. If this waiver is unenforceable with respect to a particular claim, only that claim will be pursued in court. You may opt out of the above arbitration and class action waiver provisions by sending written notice to contact@wandercraft.health within 30 days of the date you first became bound by these Terms. If mandatory law in your state conflicts with this clause and is not superseded by the FAA, such law shall apply only to the extent necessary; otherwise, this clause shall remain in full force and effect.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. If Wandercraft fails to enforce a provision, this shall not constitute a waiver of the corresponding right. These Terms and Conditions, together with the Privacy Policy and all applicable supplementary notices, constitute the entire agreement between you and Wandercraft with respect to the Platforms, unless separate written agreements govern specific products or services.

The Eve by Wandercraft app (the “Eve App”) is intended exclusively for adult users of Wandercraft’s Eve personal walking exoskeleton (“Eve”) who have been validated by Wandercraft for access. You represent and warrant that you are at least eighteen (18) years old, that you are using an email address approved and pre-validated by Wandercraft, and that you are authorized to access the Eve App. Individuals under the age of eighteen (18) may not create or use an account.
You may use the Eve App solely for your personal, lawful, and non-commercial use in connection with your authorized use of Eve.
The Eve App is an optional digital companion tool for Eve users. The Eve App was developed to help users view information and manage their personal records regarding their use of the exoskeleton.
Depending on the features available to you, the Eve app allows you to view real-time usage information, track your step count, time spent standing, and time spent walking, view weekly and monthly statistics, track goals and progress, record self-reported well-being indicators such as digestion, pain, mood, and sleep, and create optional private notes about your well-being.
Content entered into the Eve App is intended for your personal use, unless you expressly authorize its sharing.
The Eve App is intended solely as a supportive informational tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition; it is not a substitute for the instructions for use applicable to Eve, nor for the judgment, advice, and supervision of your doctor, physical therapist, or other qualified healthcare professionals.
Always follow the clinical, safety, and operational instructions provided with your exoskeleton, as well as any advice from qualified healthcare professionals. Do not change your treatment, rehabilitation, or use of the device based on information displayed in the Eve app. If you believe you are experiencing a medical emergency, call emergency services immediately and do not rely on the Eve app.
Wandercraft does not guarantee that the Eve App will always be available in real time, free of errors, or suitable for clinical decision-making. Separate instructions, labels, warranties, and terms and conditions may apply to the exoskeleton itself, which are independent of these terms and conditions.
Your use of the Eve App involves the collection and processing of personal data and health-related information, including account information, technical data, application logs, exoskeleton usage data, and self-reported well-being data. We may also anonymize or aggregate information to use it—to the extent permitted by law—for internal analysis, product improvement, support, maintenance, and strategic evaluations.
The app does not collect precise or approximate location data, does not collect biometric data, and does not process payment card data through the app. The app is not supported by advertising partners, and Wandercraft does not sell any personal data through the Eve app.
The Eve App allows you to enter private notes about your well-being and related self-reported information. In the relationship between you and Wandercraft, you retain the rights to the content you provide; however, you grant Wandercraft a limited, non-exclusive, and worldwide right to host, store, process, transmit, and display this content to the extent necessary for the operation, security, support, improvement, and maintenance of the Eve App and related services, as well as to the extent described in the Privacy Policy or permitted by law.
The Eve App currently does not include subscriptions, in-app purchases, or payment features. However, your use of the Eve App may still incur charges from your mobile service provider, data charges, device costs, or separate commercial agreements related to Eve or associated services; these are covered by these Terms only if expressly stated.
The Eve App may use third-party services, including cloud infrastructure providers, analytics systems operated by or on behalf of Wandercraft, mobile operating systems, app distribution platforms, and identity providers such as Apple and Google. Your use of third-party services may also be subject to the terms and conditions and privacy policies of those third parties.
If you access the Eve App through the Apple App Store, you acknowledge that these terms are entered into between you and Wandercraft, and not with Apple, and that Apple is not responsible for the Eve App or its content. To the extent permitted by law, Apple is not obligated to provide maintenance or support services for the Eve App. If you access the Eve App through Google Play, you also acknowledge that these terms are entered into between you and Wandercraft, not with Google, and that Google is not responsible for the support or maintenance of the app.
You agree to comply with all applicable third-party terms and conditions when using the Eve App. For iOS users, Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and may enforce these terms against you as third-party beneficiaries.
Subject to your compliance with these Terms, Wandercraft grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install the Eve App on compatible devices and to use it solely for your own authorized use.
Wandercraft may provide an optional physician portal (“Follow Eve”) through which a physician can request access to an Eve user’s usage data. If you are a physician authorized by Wandercraft, Wandercraft grants you a limited, non-exclusive, and revocable license to access Follow Eve solely for the purposes set forth herein. No other rights are granted.
You represent and warrant that you are a physician, that you are using an email address that has been approved and pre-validated by Wandercraft, and that you are authorized to access Follow Eve.
You are responsible for protecting your login credentials and for all activities that occur under your account. Login credentials must not be shared with anyone. You must immediately notify Wandercraft of any suspected unauthorized access to your account or to Follow Eve.
Wandercraft may suspend or terminate your access to Follow Eve without prior notice in the event of an actual or suspected violation of these Terms.
You may use Follow Eve solely in your capacity as an authorized healthcare professional or authorized staff member, for the purpose of billing in connection with your patients’ use of Eve.
The usage data is provided solely for informational purposes and does not constitute medical advice. It is not a substitute for your independent clinical judgment, and you remain solely responsible for all clinical decisions regarding your patients. The use of Follow Eve for any other commercial purposes, including the resale of data or access by third parties, is prohibited.
Wandercraft does not guarantee that Follow Eve will always be available in real time, error-free, or suitable for clinical decision-making. You may access and use patients’ personal data only to the extent necessary for billing related to your patients’ use of Eve, and only in accordance with applicable data protection and health information privacy laws, including HIPAA and, where applicable, the GDPR. You are solely responsible for your own compliance obligations as a “covered entity” (or as a data controller under data protection law) with respect to this data.
Follow Eve currently does not include any subscriptions, in-app purchases, or payment features. However, your use of Follow Eve may still incur device costs or be subject to separate commercial agreements related to Eve or related services; these are covered by these Terms only if expressly stated.
Follow Eve may use third-party services, including cloud infrastructure providers, analytics systems operated by or on behalf of Wandercraft, and identity providers such as Apple and Google. Your use of third-party services may also be subject to the terms and conditions and privacy policies of those third parties.
